1. Acceptance of Terms and Eligibility

By creating an account or using LastBeacon ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you must have parental or legal guardian consent. See our Privacy Policy Section 7 for details on children's privacy.

2. Service Description

LastBeacon is a personal safety application that provides:

  • A configurable check-in timer
  • An encrypted digital vault for notes, documents, and location data
  • Guardian verification when a check-in is missed
  • Automated vault release to designated recipients if no check-in or guardian response occurs

The Service is designed as a supplementary safety tool. It is not a substitute for emergency services, law enforcement, or professional safety systems.

3. No Guarantee of Delivery or Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." MSS Ventures LLC does not guarantee:

  • Uninterrupted availability of the Service
  • Timely delivery of emails, notifications, or vault releases
  • That the Service will function correctly on all devices, networks, or in all regions
  • That encrypted data can always be successfully decrypted and delivered

Factors outside our control — including but not limited to email provider outages, network failures, device incompatibility, recipient email filtering, DNS propagation delays, and third-party service disruptions — may prevent or delay vault release.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MSS VENTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, revenue, profits, or business opportunities
  • Damages arising from reliance on the Service for personal safety
  • Failure or delay in vault release, notification delivery, or guardian verification
  • Unauthorized access to vault contents due to factors beyond our reasonable control
  • Any harm resulting from the content stored in user vaults

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

5. Journalist and High-Stakes Use Disclaimer

LastBeacon may be used to store sensitive materials including but not limited to journalistic sources, legal documents, whistleblower evidence, or personal safety plans.

Users who store materials where delivery failure could result in serious harm must understand:

  • The Service is a best-effort delivery system, not a guaranteed one
  • No technology can guarantee 100% uptime or delivery reliability
  • Users should maintain independent backup systems for critical materials
  • The Service does not provide legal privilege, source protection, or evidentiary chain of custody
  • MSS Ventures LLC assumes no liability for consequences of failed, delayed, or intercepted vault release

We strongly recommend that users with high-stakes use cases:

  • Maintain offline copies of critical materials
  • Designate multiple recipients for important vault items
  • Test the vault release flow with non-sensitive data before relying on it
  • Consult legal counsel regarding the suitability of this Service for their needs

6. User Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials and recovery key
  • Ensuring your guardian and recipient contact information is accurate and current
  • Understanding that vault release is irreversible once triggered
  • Complying with all applicable laws regarding the content you store
  • Not using the Service for illegal purposes, harassment, or to harm others

7. Content and Encryption

  • Vault contents are encrypted on your device before upload. MSS Ventures LLC cannot access, read, or recover your encrypted vault contents.
  • If you lose both your password and recovery key, your vault data is permanently inaccessible. We cannot help you recover it.
  • You retain ownership of all content you store in the Service.

8. Account Termination

  • You may delete your account at any time. Deletion permanently removes all data including vault items, contacts, and encryption keys.
  • We may suspend or terminate accounts that violate these Terms, with notice when practical.
  • Auto-Destruct mode, if enabled, will permanently purge vault data instead of releasing it.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

10. Indemnification

You agree to indemnify and hold harmless MSS Ventures LLC from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via the app or email. Continued use after changes constitutes acceptance. The "Last updated" date at the top reflects the most recent revision.

12. Governing Law

These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict of law provisions.
